Este trabalho pretende descrever a denominada questão normativa, apresentada pela Professora Christine M. Korsgaard em seu The Sources of Normativity, e, depois, apresentar a filosofia moral tomista, procurando, nela, uma possível resposta ao problema. O trabalho, primeiro, introduz o pensamento moral de Korsgaard, apresentando o problema, e o seu argumento para encontrar a fonte da normatividade. Em um segundo momento, apresenta os fundamentos da teoria moral de Tomás de Aquino, aprofundando-se, especialmente, no estudo do ato voluntário – dado seu caráter (...) central no estudo da moral – e da ordenação dos atos ao fim. Por fim, procura-se compreender a natureza da lei moral, com destaque para as noções de obrigação e de sanção. (shrink)

RESUMEN A pesar de que la reducción de R. Descartes de los animales a meras máquinas puede explicarse como una consecuencia lógica de su punto de partida metafísico y gnoseológico, se puede argüir que esta reducción parece muy difícil de defender, puesto que se nos antoja contradictoria con nuestra experiencia cotidiana. Por otra parte, uno de los propósitos de la filosofía de Descartes es la “conservación de la salud”, que puede conseguirse mediante el establecimiento de una medicina “fundada en demostraciones (...) infalibles”. De cara a conseguir tal medicina el primer paso es alcanzar el conocimiento más preciso posible del cuerpo humano a fin de tener éxito en la práctica de la cirugía. De ahí que sea bastante plausible afirmar que la metafísica y la teoría del conocimiento de Descartes no serían sus principales intereses teóricos, sino solamente una explicación y justificación ingeniosas de lo que la ciencia de su tiempo llevaba haciendo no menos de cien años antes de él, así como una inteligente manera de obviar los escrúpulos cuando se anatomizaban cadáveres humanos y animales. En consecuencia, en este artículo mantendremos que el mecanicismo y dualismo cartesianos son una verdadera filosofía de la ciencia, desde el momento en que ambos estaban dedicados a explicar y justificar lo que la ciencia estaba haciendo en la práctica. ABSTRACT Despite of the fact that R. Descartes’s reduction of animals to mere machines can be explained as a logical consequence of his metaphysical and gnoseological starting point, one can argue that this reduction seems to be very difficult to defend, since it appears to be contradictory to our everyday experience. On the other hand, one of the explicitly confessed purposes of Descartes’s philosophy is the “conservation of health”, which can be achieved by establishing a medicine “founded in infallible demonstrations”. The first step in order to get such medicine is to acquire the most accurate as possible knowledge of the human body in order to be successful in practicing surgery. That is why it is fairly plausible to state that Descartes’s metaphysics and theory of knowledge were not his main theoretical concerns, but only a witty explanation and justification of what the science of his time was doing for no less than one century before him, as well as a clever manner to avoid scruples when anatomising both human corpses and animals. Consequently, in this paper we will claim that Cartesian mechanicism and dualism are actual philosophies of science, given the fact that both were devoted to explain and justify what science was in practice doing. Este artículo analiza el lugar del exilio de la última dictadura militar en el campo de estudios sobre el pasado reciente argentino e intenta tanto dar cuenta de las líneas más transitadas y que permiten plantear que estamos frente a un territorio historiográfico en expansión, como descubrir cuáles son las actuales áreas de vacancia y las de mayor potencial para la investigación académica futura. Lejos de pretender hacer un examen exhaustivo de la producción que viene acumulándose desde la contemporaneidad del (...) fenómeno hasta hoy, estas páginas constituyen más bien un intento de revisar críticamente una parcela de la Historia Reciente desde el examen de la propia práctica investigativa y de cara a sacar a la luz los dilemas y desafíos que la atraviesan. En este artículo, se presenta un análisis comparado entre los procesos históricos de colonización y descolonización en Asia y África. Se observa que, aunque la exploración de Asia es globalmente anterior a la de África, desembocó en el colonialismo, marcado por la competencia entre potencias imperialistas y su afán de dominio. Así, el objetivo de este trabajo es traer a la luz algunos elementos clave para reflexiones críticas y comparadas acerca de estas dinámicas de dominación de ambas regiones por parte (...) de los colonizadores en los siglos XVI y XX; igual que las lecciones derivadas de las mismas de cara al actual orden político. Este artículo es una reflexión acerca del capítulo quinto de la encíclica Laudato si’ del Papa Francisco. En primer lugar se argumenta la legitimidad del Papa para hacer propuestas políticas, sociales y económicas. A continuación se analizan cuatro principios básicos para estas propuestas: el tiempo es superior al espacio, la unidad es superior al conflicto, la realidad es superior a la idea, y el todo es superior a la parte, tomando también como referencia las encíclicas Lumen fidei y Evangelii gaudium. (...) El grueso del artículo se centra en las propuestas para la política internacional, nacional y local, con citas y referencias del propio Papa y de otros documentos. Otras cuestiones que son objeto de análisis son los procesos de intervención específicos, la relación entre política y economía, y el diálogo religiónciencia. Se concluye con la necesidad de que el Papa se pronuncie sobre estas cuestiones de cara a una ecología integral y el cuidado de la casa común –el mundo– a la luz del Evangelio. (shrink)

El artículo examina la concepción hegeliana del arte moderno a la luz de las consideraciones sobre el teatro en las Lecciones de estética. Dicha concepción se modifica respecto a la época clásica y la antigüedad con la irrupción del principio de la subjetividad en el arte. Se descubren así las dimensiones histórica, reflexiva y comprensiva del arte que anticipan una hermenéutica del arte bajo la consigna de un “arte para nosotros”: un arte que deja de estar anclado en las representaciones (...) del pasado para situarse más bien de cara a las exigencias del presente. El presente trabajo pretende ofrecer una aproximación a la pintura impresionista desde la fenomenología francesa contemporánea. De cara a problematizar el papel histórico del impresionismo, partiremos de la crítica de arte de Charles Baudelaire para dilucidar en qué medida dicho movimiento participa de la modernidad artística. Sin embargo, el objetivo principal que nos proponemos no es una lectura histórica, sino fenomenológica: pretendemos superar las interpretaciones reduccionistas que presentan dicho movimiento pictórico o bien como una pulsión naturalista por representar miméticamente (...) los efectos de la luz sobre la retina, o bien como una representación subjetivista que interpreta la impresión como “sensación” psicológica. Más acá de ambos reduccionismos, el impresionismo se nos mostrará en una lectura fenomenológica como el intento de hacer el encuentro con el mundo, y su uso del color se revelará como des-velamiento (aletheia) o mostración de lo real. El trabajo de Wittgenstein es el documento de una lucha filosófica de toda la vida por comprensiones en el límite de lo pensable y su expresión adecuada, basada en la idea de limitar el alcance de lo racionalmente expresable desde adentro para ganar intuiciones más allá. Como consecuencia de su forma de pensar de doble cara, a menudo se puede sentir una tensión entre pensamientos o formas de argumentación aparentemente opuestas que a veces conducen a malas interpretaciones. En este (...) artículo se mostrará que la idea de «correr contra los límites del lenguaje» (y tratar de echar un vistazo al otro lado) fue absolutamente central para la filosofía temprana y posterior de Wittgenstein, sin embargo, todavía dejando la puerta entreabierta para explicaciones metafísicas. A partir de la concepción de un Wittgenstein de doble cara, al mismo tiempo positivista y metafísico, se puede explicar mas convincentemente la función de su introducción del concepto de «juegos de lenguaje». Se vuelve posible también arrojar nueva luz sobre su concepción de la semántica y el así llamado «argumento del lenguaje privado». (shrink)

Puede decirse, sin ir demasiado lejos, que la obra del sociólogo francés de Pierre Bourdieu ha sido una de las más brillantes e imaginativas del panorma de las ciencias sociales en la segunda mitad del siglo XX. Este libro trata de sacar a la luz la forma en la que las herramientas de su sociología fueron creadas. No obstante, este texto no comienza con un realto de sus obras, sino de su vida. Pierre Bourdieu no nace intelectual, se hace en (...) un contexto que -en su caso, especialmente durante sus primeros años de su vida- tiene poco de tal. Se trata, pues, de una investigación histórica de la figura de un intelectual que evita dos caminos ya trillados: la vía externalista, que toma a los eventos históricos, sociales o económicos como fuente de toda explicación de la vida intelectual y científica, y la vía internalista, que cosidera que sus miembros viven en una esfera aislada y ajena a toda influencia exterior. Está última vía es la que se suele transitar cuando un pensador ha legado una obra que despierta admiración. Para ello, el autor emplea algunas de las ideas que Randall Collins delineo en su opus magnum Sociología de las filosofías, quizá uno de los libros que mejor ha sabido captar las dinámicas que gobiernan el mundo intelectual. Más concretamente, el autor de este libro hace suya la idea de que son las interacciones cara a cara las relaciones fundamentales que gobiernan la vida intelectual. (shrink)

La aportación de González se articula en torno a un criterio de discriminación denominado como verdad primera que (...) son nuestros actos elementales, elementos constituyentes de nuestra praxis Las estructuras de la praxis es un esquema para la detección de identificaciones erróneas, en sus diferentes niveles y articulaciones, de cara a podernos despojar de artificiosidades superfluas, para así poder acceder a un nivel de conciencia de nosotros mismos más claro y despejado, desde el que poder reconsiderar toda nuestra actuaciones a la luz de alguna verdad sentida como más netamente propia. INTRODUCTION BY NANCY FUMERO What is a translation that stalls comprehension? That, when read, parsed, obfuscates comprehension through any language – English, Portuguese. It is inevitable that readers expect fidelity from translations. That language mirror with a sort of precision that enables the reader to become of another location, condition, to grasp in English in a similar vein as readers of Portuguese might from João Guimarães Rosa’s GRANDE SERTÃO: VEREDAS. There is the expectation that translations enable mobility. That what was (...) written in one language be accessible in another. And that a translator is to serve as a mediator, acting ultimately in service to ideas within the source text. To disperse them. However, this notion of translation is partly antithetical to the ideas in Rosa’s work. Or, alternately, to convey the despair of terrain slipping beneath one’s feet, and to encounter the heightened suspense of magic, the translation, as part of its strategy, cannot devotedly rely on its original language, not as its source text. The work undertaken by Felipe W.Martinez is a new form of translation that risks everything in order to encounter the same treacherous knowing Rosa had traversed. And it takes its risks by not taking risks: by being, almost word for word, a literal translation. This is an approach that reductively converts, as opposed to translates. The idiomatic differences between English and Portuguese are not accented. The syntax is not finessed. Liberties are not assumed on account of improving readability. What stands, resoundingly amid such absences, is the awakened challenge of reading. The genuine peril of not knowing. That is, this translation, one that purports to know nothing, creates access into the guileful world Rosa had created in Portuguese. But not by translating. If anything, GRANDE SERTÃO: VEREDAS is speaking a cosmic language through a linguistic one. And W.Martinez does us the service of recognizing this, as what configures the shapes of words and sentences is not as simple as neologisms, portmanteaus, and digressions, but as terrifying as the path the fool traverses: all paths. As such, this translation doesn’t speak English, just as the original does not speak Portuguese. It is the assemblage of paradox as a new logic that can be navigated, if only one could suspend the comfort of readability, of expectation. If one could descend a mountain in the pitch dark of night, each step shocking the body, unable to acclimate to the unleveled heights. Without a doubt, the translation is incongruous to the Portuguese. Taking a small excerpt to compare: Eh, well, thereafter, the rest the Sir provide: comes the bread, comes the hand, comes the god, comes the dog. What is striking is the interplay between “god” and “dog”. To most English speakers, this anagram is a familiar one. But in Portuguese the words god (“deus”) and dog (“cão”) are not so closely linked. In fact, there is no direct mention of “deus” in Rosa’s text: Eh, pois, empós, o resto o senhor prove: vem o pão, vem a mão, vem o são, vem o cão. Both are fascinating. In Rosa’s excerpt, the rhythm is unmistakable and precise, despite, of course, the indices of hesitation: the commas, the Eh, the uncomfortable way of searching through prolongation and wait. This is the sort of paradox Rosa can engage within a sentence. W.Martinez’s does this as well, at a scale that reverberates beyond the sentence, and with one noticeable addition: deus. What may appear to be an overstep, to add such a weighted word that draws out wordplay but is, nevertheless, not in the source text, is exemplary of risk. The translation buzzes because of it. This is because throughout the text we encounter dogs frequently, as some primal beast on par with humans. The dog is one that masters and can be mastered. A creature that is at times its face, and at others a mask. It is a powerful presence. For the translator to be attuned to the reverent undercurrent attributed to this animal, and create within the translation such charged play in English from what was only an implication in Portuguese, is in tribute to the grand beauty within dissonance. What aberrant modes of writing and translation can teach us most assuredly, is that things, words, are not in states of rightness or wrongness, but of oscillation. This isn’t so different from what Rosa says himself: The Sir look…see: the most important and beautiful, of the world, is this: that the people are not always same, still were not completed — but that they go always shifting. They tune or detune. We find this so readily in W.Martinez’s translation, this tuning and detuning. O Urucuia vem dos montões oestes. Mas, hoje, que na beira dele, tudo dá – fazendões de fazendas, almargem de vargens de bom render, as vazantes; culturas que vão de mata em mata, madeiras de grossura, até ainda virgens dessas lá há. Rincha- Mãe, Sangued’Outro, o Muitos-Beiços, o Rasgaem-Baixo, Faca-Fria, o Fancho-Bode, um Treciziano, o Azinhavre... o Hermógenes... Deles, punhadão. Se eu pudesse esquecer tantos nomes... Não sou amansador de cavalos! E, mesmo, quem de si de ser jagunço se entrete, já é por alguma competência entrante do demônio. Será não? Será? De primeiro, eu fazia e mexia, e pensar não pensava. Me agradou que perto da casa dele tinha um açudinho, entre as palmeiras, com traíras, pra-almas de enormes, desenormes, ao real, que receberam fama; o Aleixo dava de comer a elas, em horas justas, elas se acostumaram a se assim das locas, para papar, semelhavam ser peixes ensinados. Pois essezinho, essezim, desde que algum entendimento alumiou nele, feito mostrou o que é: pedido madrasto, azedo queimador, gostoso de ruim de dentro do fundo das espécies de sua natureza. A ciência não é livre de valores. Piotr Kropotkin foi um renomado naturalista, bem como o anarquista mais lido do século XX. Meu objetivo neste ensaio é analisar seu pensamento evolutivo, tal como expresso em sua principal obra Apoio Mútuo: um fator de evolução (1902). Eu exponho teses centrais da teoria evolutiva de Kropotkin, situando-as em seu contexto e à luz do conhecimento atual. Basicamente, nosso autor defendia que (1) as espécies não são fixas, isto é, modificam-se ao longo do (...) tempo; (2) essa modificação não segue um plano divino; (3) as espécies possuem um ancestral comum; (4) o ambiente produz e seleciona características vantajosas nos organismos; (5) a “luta pela vida” é mais vantajosa quando os organismos se associam do que quando eles competem entre si; e (6) as vantagens da associação (apoio mútuo) lhe conferem um caráter progressivo na evolução, fornecendo as bases para a ética e para o socialismo anarquista. A natureza cooperativa e progressiva da teoria de Kropotkin oferece um excelente modelo para abordar o papel de valores na ciência. (shrink)

Una de las novedades de la teoría mimética consiste en su mirada particular sobre el deseo humano y de sus despliegues en el campo de la literatura, asunto que ha sido materia de estudio por la filosofía, la antropología y la fenomenología. Buscamos a continuación explorar desde los insumos teóricos que se mencionan esbozar algunas ideas sobre la filosofía literaria y cómo estos mismo pueden ser brújula para orientar el lector en el estudio e interpretación de una obra literaria del (...) canon nacional: La Vorágine de José Eustasio Rivera. ¿En qué radica la novedad del planteamiento filosófico que se ha formulado en el presente ensayo? Básicamente en mostrar que la teoría mimética deriva en una filosofía literaria, que conecta con un análisis fenomenológico a propósito de cómo surge la violencia social a la luz de la expresión literaria. Para llevar a cabo dicho cometido, la propuesto se desglosa de la siguiente manera: en primer lugar, se propone una idea de lo que se entiende por filosofía literaria en relación con la apuesta del pensamiento de René Girard. Hecho esto, se procede a tematizar las relaciones entre fenomenología y teoría mimética en donde se profundiza en el análisis filosófico de los conceptos de la experiencia, el otro, la rivalidad, la vida y el deseo y la relación que guardan con la literatura. En un tercer momento, se propone el análisis filosófico que en clave mimética se aplica a la novela La Voràgine del escritor huilense José Eustasio Rivera. Finalmente, se propone en las conclusiones otros acercamientos a la teoría del deseo mimético y sus vínculos con el estudio filosófico de la literatura, de cara a la dialéctica del reconocimiento y sus intérpretes contemporáneos según la postura girardiana. Ecological refugees are expected to make up an increasing percentage of overall refugees in the coming decades as predicted climate change related disasters will displace millions of people. In this essay, I focus on those rights ecological refugees may claim on the basis of collective self-determination. To this end, I will focus on a few specific cases that I call cases of ‘ecological refugee states’. Tuvalu, the Maldives, and to a certain extent, Bangladesh are predicted to be ecological refugee states (...) in the near future. These are states whose entire (or close to it) geographical territory is predicted to be lost to rising sea levels; the collective body of the people will itself become an ecological refugee.The question is: what may the people of an ecological refugee state legitimately claim on the basis of their right to self-determination? Should we redraw state borders to accommodate a New Tuvalu? I argue that a plausible position regarding territorial rights is that when (1) a people clearly is (or recently was) self-determining and has a legitimate claim to continue to be self-determining, and (2) the self-determination of a people is existentially threatened because the people lacks territorial rights, that (3) the people becomes a candidate for sovereign over a new territory. The result is that existing state borders may need to change to accommodate something like a New Tuvalu. To generate these results on behalf of ecological refugee states, I examine the principles of the system of territorial states. Because the system of territorial states is a system of exclusive rights over goods, especially land, it is possible that it is subject to the conditions of a Lockean proviso mechanism. This paper is dedicated mainly to adapting a version of the Lockean proviso for use in territorial rights theory. (shrink)

In this paper, I critically examine an important premise in theories of global distributive justice that, despite its widespread influence, has remained largely unexamined. This is the claim that state borders are morally arbitrary with respect to a just distribution of goods. I examine two common arguments for this claim, the argument that state borders are historically unjust and therefore morally arbitrary; and the argument first made by Charles Beitz that the conditions of a fair, hypothetical social contract would not (...) include knowledge of one's location with respect to the distribution of natural resources between state borders. I argue that there are good reasons to reject both arguments. Beitz's immense contribution to international justice can be gauged by the fact that it is difficult to find a contemporary work on global justice that does not reference his arguments in Political Theory and International Relations . Although some authors find Beitz's cosmopolitan theory objectionable, no author has, to my knowledge, criticized Beitz's pivotal arguments that our placement in the distribution of natural resources is morally arbitrary. Some time ago, John Perry argued that the content of an indexical belief, that is, a belief expressible with a sentence containing an indexical or demonstrative, cannot be a proposition. I consider several of his arguments for this view, and show that they can be extended to show that belief expressible with other non-indexical expressions such as natural kind terms and proper names presents the very same problem for the traditional picture. I then suggest that if indexical belief has any (...) special status, this is not because it has a special kind of content, but rather because action is impossible if agents do not have indexical belief. This essay defends a strong right against displacement as part of a basic individual right to secure access to one’s home. The analysis is purposefully situated within the difficult context of climate change adaptation policies. Under increasing environmental pressures, especially regarding water security, there are weighty reasons motivating the forced displacement of persons—to safeguard water resources or prevent water-related disasters. Even in these pressing circumstances, I argue, individuals have weighty rights to secure access to their homes. I explain how the (...) home provides a functional context for conditions of autonomous agency. Being coerced from the home disrupts and subverts the conditions necessary for autonomous processes. I conclude by suggesting that the right to the home could be a foundational element of territorial rights. (shrink)

This article examines theories of ocean rights based on the works of Hugo Grotius and Samuel von Pufendorf. Grotius's object‐centred view uses features of the natural world to justify claims to external objects. I show that Grotius's view is inadequate, because it relies on an outdated claim that oceanic resources are sufficiently abundant for anybody to use. Further, adaptations of his view are wanting, because they either rely on arbitrary distinctions or disregard the values of cultural minorities. Pufendorf's relational view (...) constructs rights through the exercise of human will. While Pufendorf believes that agreements create rights, he also argues that property rights can be unilaterally acquired from the commons without express consent from others. The relational view is a viable alternative to the object‐centred view, because it both delimits territorial claims over the ocean to a ‘modest’ size and also respects cultural variability. A major aim of this article is to present Pufendorf's theory of territorial rights extended over oceans and to demonstrate how it is useful for assessing contemporary disputes. In the final sections, I apply the relational view to Canadian claims to the Northwest Passage, and I also sketch implications for assessing expanding claims to the seabed. (shrink)

This essay examines the most recent justifications for a people's exclusive right to resources as part of a territorial right. Divided into eight parts, the discussion covers contemporary philosophical discussion regarding: the conception of natural resources, the conception of resource rights, the general form of arguments supporting resource rights, arguments from self-determination, objections to arguments from self-determination, arguments from residence, arguments from improvement, and new directions for research in the future.

Predictive genetic testing is now routinely offered to asymptomatic adults at risk for genetic disease. However, testing of minors at risk for adult-onset conditions, where no treatment or preventive intervention exists, has evoked greater controversy and inspired a debate spanning two decades. This review aims to provide a detailed longitudinal analysis and concludes by examining the debate's current status and prospects for the future. Fifty-three relevant theoretical papers published between 1990 and December 2010 were identified, and interpretative content analysis was (...) employed to catalogue discrete arguments within these papers. Novel conclusions were drawn from this review. While the debate's first voices were raised in opposition of testing and their arguments have retained currency over many years, arguments in favour of testing, which appeared sporadically at first, have gained momentum more recently. Most arguments on both sides are testable empirical claims, so far untested, rather than abstract ethical or philosophical positions. The dispute, therein, lies not so much in whether minors should be permitted to access predictive genetic testing but whether these empirical claims on the relative benefits or harms of testing should be assessed. Historical injustice and global inequality are basic problems embedded in territorial rights. In Global Justice and Territory Cara Nine advances a general theory of territorial rights adapting a theoretical framework from natural law theory to ground all territorial claims.

In ‘What’s Wrong with Colonialism,’ Lea Ypi argues that the wrong of colonialism can be expressed as procedural wrongs, not as wronging territorial rights. On her view, colonial practices went wrong in two ways: they forced residents into political associations, and the terms of the political association were not established through equal and reciprocal negotiations. I argue that because Ypi’s account successfully side-lines all but essential claims to territory, her theory ends up being vulnerable to an objection it means to (...) avoid. Historical residents may be subject to unequal treatment under newly formed political associations because their historical patterns of land use are not considered to have any independent moral weight. My analysis does not rely on any appeal to property or territorial rights. Instead, I appeal to pre-existing obligations holding between residents. (shrink)

This first-of-its-kind national survey of 485 psychiatrists in nine states and the District of Columbia finds substantial evidence of clinicians being uninformed, misinformed, and misinforming patients of their gun rights regarding involuntary commitments and voluntary inpatient admissions. A significant percentage of psychiatrists did not understand that an involuntary civil commitment triggered the loss of gun rights, and the majority of psychiatrists in states with prohibitors on voluntary admissions and emergency holds were unaware that patients would lose gun rights upon voluntary (...) admission or temporary commitment. Moreover, the survey found evidence that psychiatrists may use gun rights to negotiate “voluntary” commitments with patients: 15.9% of respondents reported telling patients they could preserve their gun rights by permitting themselves to be voluntarily admitted for treatment, in lieu of being involuntarily committed. The results raise questions of whether psychiatrists obtained full informed consent for voluntary patient admissions, and suggest that some medical providers in states with voluntary admission prohibitor laws may unwittingly deprive their patients of a constitutional right. The study calls into question the fairness of state prohibitor laws as policy, and — at minimum — indicates an urgent need for psychiatrist training on their state gun laws. (shrink)

In response to the abundance of parenting literature and a contemporary emphasis on expertise, recent scholars have suggested that how we parent should be determined by values and a family’s particular needs, a combination often referred to as practical wisdom. In this article, I build on previous calls for an ethical approach to being a parent. I argue that being able to share and cultivate one’s unique personality and have one’s aptitudes and interests recognized is a key condition of living (...) well and that parents play an important role in helping their children know and realize their gifts. I put forth an exercise for attending to children, the descriptive review of the child. In doing so, I first describe this practice, illustrate it, and then explain how it can help one live well as a parent. (shrink)

Communicable diseases, especially those that are readily contagious, are on the rise as evidenced by the emergence of viruses like severe acute respiratory syndrome, the global resurgence of resistant forms of ancient mycobacteria such as extensively drug resistant tuberculosis, and the 2009 swine flu outbreak in Mexico. Moreover, each of us, no matter who we are or where we live, is just as likely to transmit contagious diseases to others as we are to contract such diseases from others. As cogently (...) described in the title of a recent book by Margaret Battin et al., we are all potential “victims and vectors.”Just as contagious diseases are readily passed person to person, so too can they readily be passed across local and national boundaries. We therefore all have a stake in the development of effective infectious disease control policies on a national scale, with “effective” being the operative term: regulations and statutes that are neither enforceable nor likely to be complied with may do more harm than good. This paper is premised on the understanding that racism is deeply and widely entrenched in our culture and the ethical claim that we operate within complex networks of habituated practices. Within this framework, we ask how do we disrupt these calcified, complex, and racist ways of being? Specifically, we explore how teachers are habituated into particular ways of seeing and acting. We argue generally that conscious cultivation can promote greater equity and specifically that changing teacher talk is a necessary part (...) of this cultivation if racist norms are to be disrupted and replaced with more equitable ways of seeing in schools. In making this argument, we draw on a practice, Descriptive Inquiry, to cultivate more equitable talk and describe how it led to changes in four urban public schools. (shrink)

Emotions situate actors in relationships and shape their social interactions. Culture defines both the qualities of individual identity and the constitution of social groups with distinctive values and practices. Emotions, then, are necessarily experienced and acted upon in culturally inflected forms that define not only the conventions of their articulation through individual and collective action, but also the very words that name them. This article develops theoretical arguments to support these claims and illustrates their application in a description of differing (...) emotional repertoires, and their consequences, in Aotearoa New Zealand. The effects of resentment and shame in an ethnic politics of rights and antidiscrimination law demonstrate that context is central to a nuanced understanding of how law and emotions connect in the practicalities of enforcing the protections of anti-discrimination law.
